Can I be terminated from my job without any notice period?

Asked by Anonymous · Answered 18 Jan 2026

The Question
My employer terminated me abruptly, without giving the notice period mentioned in my appointment letter or paying me in lieu of it. Is this legal?

Generally, no — unless your termination was for proven serious misconduct (which typically requires a proper disciplinary enquiry first), your employer is expected to honour the notice period specified in your employment contract, or pay you compensation in lieu of that notice.

If your appointment letter or company policy specifies a notice period, and your employer terminated you without either serving that notice or paying you the equivalent salary, this can amount to a breach of your employment contract, potentially entitling you to claim that unpaid amount.

Depending on your specific category of employment and the state you're in, you may also have additional protections under labour law beyond just the contract terms. It would help to review your appointment letter and any termination communication carefully with a labour lawyer, who can advise on the best way to pursue the notice pay you're owed.
