Can I withdraw a domestic violence case after filing it?

The Question
I filed a domestic violence complaint against my husband some months ago, but we have since reconciled and I want to withdraw the case. Is that possible?

Yes, it's generally possible to withdraw or not pursue a domestic violence case, though the exact process can depend on what stage the case is at and what specific reliefs (protection order, monetary relief, etc.) were sought and possibly already granted.

For reliefs sought under the civil domestic violence framework (protection orders, residence orders, and similar), you can typically inform the court of the reconciliation and seek to withdraw the application, and the court will generally accept this if satisfied it's a genuine, voluntary decision.

If there's also a connected criminal complaint (for instance, under cruelty provisions), the process for that is somewhat different and generally requires a compounding application, which for some offences also requires the court's permission rather than being automatic. It would be worthwhile to consult the lawyer who filed the original case to make sure withdrawal is handled correctly for each specific proceeding involved.
