What can I do if my builder is not giving me the occupancy certificate?

Asked by Anonymous · Answered 30 Jan 2026

The Question
I have already moved into my flat, but the builder still hasn't provided the occupancy certificate despite the building appearing to be complete. What should I do?
Answer — MyLawIndia Legal Team

Without an occupancy certificate, your occupation of the flat can technically be considered unauthorised, and you may also face practical difficulties later — such as getting a home loan for resale, obtaining certain utility connections, or reselling the property to a buyer who insists on seeing this document.

You can send a formal written demand to the builder requiring them to obtain and provide the occupancy certificate, and if they continue to delay without valid reason, you can file a complaint with RERA, which has the power to direct builders to complete such pending compliances and can also impose penalties for the delay.

If the delay stems from the builder's own non-compliance with building regulations (such as deviations from the sanctioned plan), this can become a more complex issue requiring you to understand exactly what compliance gap is preventing the certificate from being issued. An advocate handling RERA matters can help you draft the right complaint and push for a resolution.
