Fraud Case Law
Fraud (Civil)
A false representation of fact, made knowingly or recklessly, with the intent to deceive another party and induce them to act to their detriment.
Civil fraud allows the deceived party to seek remedies including rescission of a contract entered into because of the fraud, and damages for the loss suffered — separate from, though sometimes overlapping with, a criminal cheating complaint over the same conduct.
Proving fraud requires a higher standard of evidence than an ordinary civil claim, given the seriousness of the allegation and its potential consequences for the accused party's reputation.
