International Commercial Arbitration
Arbitration of a commercial dispute where at least one party is based outside India, or the dispute otherwise has a genuine foreign/international element.
Such arbitrations are frequently seated outside India, or conducted under the rules of international arbitral institutions, and their resulting awards can generally be enforced in India under international treaty obligations India has signed onto.
Cross-border commercial contracts commonly specify a preferred seat and rules for arbitration precisely to avoid uncertainty if a dispute later arises.
