A succession certificate is a court-issued document that helps legal heirs collect debts, securities, or other movable assets of a deceased person. You need it when the person has died without a will and there are assets like bank accounts or investments to be claimed.
Legal heirs — such as the spouse, children, parents, or siblings — can apply. The court requires proof of relationship, identity, and a detailed list of the deceased’s assets and liabilities to grant the certificate.
You file a petition to the District Judge in the court where the deceased lived or where their assets are located. The application must include death details, heir information, assets list, and be verified by affidavit. Court fees must also be paid.
The process usually takes several months — often between five to seven months — assuming there are no major objections during the notice period. Lawyers help speed up and smooth out the legal procedure.
