Medical Negligence Law
Medical Negligence
A failure by a medical professional or hospital to exercise the reasonable standard of care and skill expected in the circumstances, resulting in harm to the patient.
Establishing medical negligence generally requires showing the treatment fell below the standard a reasonably competent professional would have provided in similar circumstances — a mere unfavourable outcome isn't, by itself, sufficient proof of negligence.
Patients can pursue remedies through a consumer complaint (as medical services can qualify as a service under consumer law), a civil suit for damages, or in serious cases, a criminal complaint.
