A principle allowing a motor accident victim to claim a fixed minimum compensation without having to prove who was at fault for the accident.
No-fault liability provides quicker, guaranteed compensation for death or permanent disability in a motor accident, without the claimant needing to establish negligence — useful especially where establishing fault would otherwise take considerable time and evidence.
A claimant can still pursue a larger claim based on proving fault, separately or instead, if the no-fault amount doesn't adequately compensate their actual loss.
