Property Law
Specific Performance
A court remedy directing a party to actually carry out their contractual obligation — such as completing a property sale — rather than merely pay damages.
Where monetary compensation wouldn't adequately make up for a breach (as is often the case with unique property), a court can order specific performance, compelling the defaulting party to go through with the transaction as originally agreed.
Courts weigh factors like whether the party seeking this remedy has themselves complied with their own obligations, before granting this generally discretionary relief.
