Equality Before Law

The constitutional guarantee that every person is equal before the law and entitled to equal protection of the laws, without arbitrary discrimination.

This principle prohibits arbitrary and unreasonable classification by the state, though it does permit reasonable classification for a legitimate purpose — the law can treat different categories of people differently, as long as the distinction is rational and connected to a genuine objective.

Equality challenges are frequently raised against government policies, rules, and actions alleged to unfairly favour or disadvantage a particular group without adequate justification.
