Partition Suit (Family Property)

A civil suit filed by a co-owner or coparcener seeking their defined share of jointly held family property to be legally separated out.

Where family members jointly own property and cannot agree on dividing it amicably, any co-owner can file a partition suit asking the court to determine each party's share and physically or notionally divide the property accordingly.

Courts can order actual physical division where feasible, or direct the property to be sold and the proceeds distributed, where physical division isn't practical.
