Regular Bail

Unlike anticipatory bail, a regular bail application is filed after arrest has already taken place, seeking the accused's release from custody while the case proceeds. It can be moved before the magistrate, Sessions Court, or High Court depending on the offence and stage of the case.

Courts typically consider the evidence available, the accused's criminal history, flight risk, and whether continued custody is necessary for the investigation, before deciding whether to grant it and on what conditions.
