Constructive Dismissal
A situation where an employee resigns because the employer's conduct made continuing in the job intolerable, treated in law as equivalent to being wrongfully dismissed.
Where an employer's conduct — such as a significant unilateral demotion, harassment, or fundamental breach of the employment contract — effectively forces an employee to resign, the resignation can be treated as a dismissal for legal purposes, entitling the employee to similar remedies as if they had been directly terminated.
Proving constructive dismissal requires showing the employer's conduct was serious enough to justify treating the resignation as involuntary.
