The right of an accused person to have their case tried without unreasonable delay, recognised as part of the right to a fair trial.
While not an absolute or precisely time-bound right, courts have recognised that prolonged, unexplained delay in trial can itself be a ground for relief, including bail, given the toll indefinite pending proceedings can take on an accused.
Courts weigh the reasons for delay, and whether it is attributable to the accused, the prosecution, or systemic factors, in assessing such claims.
