Trademark Infringement
The unauthorised use of a registered trademark, or a mark deceptively similar to it, in relation to similar goods or services, likely to confuse consumers.
A trademark owner can sue for infringement where someone uses an identical or confusingly similar mark without permission, seeking remedies including an injunction stopping further use, damages, and sometimes an account of profits made from the infringing use.
Unregistered marks can still be protected through a "passing off" action, though the burden of proving reputation and likelihood of confusion is generally higher without the benefit of registration.
