Bailable Offence

An offence, usually less serious, where bail is a matter of right and can be granted by the police or a magistrate.

For a bailable offence, an arrested person has the right to be released on bail, and the police officer or court is expected to grant it on furnishing the required bond, without needing to weigh discretionary factors the way they would for a non-bailable offence.

Whether an offence is bailable or not is decided by how it is classified under criminal law, generally correlating with the seriousness of the alleged conduct and the prescribed punishment.
