Discovery of Documents
A pre-trial procedure requiring parties to disclose documents relevant to the case that are in their possession, even if not favourable to them.
Discovery lets each side find out about documents the other party is holding that are relevant to the dispute, helping ensure both sides have access to the material facts before trial, rather than one side ambushing the other with previously hidden evidence.
A court can draw an adverse inference against a party that unreasonably withholds documents it was directed to disclose.
