Ex Parte Order
An order passed by the court hearing only one side, typically because the other party failed to appear despite notice.
Courts can pass an ex parte order when the opposite party, despite being duly served with notice, doesn't appear to present their side — though such orders can usually be challenged and set aside if the absent party shows sufficient cause for their non-appearance.
Ex parte orders are generally treated as provisional in nature, since a fair hearing to both sides is a fundamental principle of the legal process.
