Summary Suit
A fast-track civil procedure available for certain claims — typically for a fixed sum of money on a written contract — where the defendant needs the court's permission to defend.
Summary suits are designed for claims where the plaintiff's case is fairly clear-cut, such as recovery of a liquidated debt under a written contract — the defendant must apply for leave to defend and satisfy the court there is a genuine, triable defence, rather than an automatic right to a full trial.
This procedure allows genuine claims to be resolved faster than the standard, more elaborate civil suit process.
