Contested Divorce
A divorce sought by one spouse on legally recognised grounds, where the other spouse does not consent and the matter is decided by the court.
A contested divorce is filed by one spouse alone, on a specific ground recognised by the applicable personal law — such as cruelty, desertion, or adultery — while the other spouse may contest the petition and deny the allegations.
Because evidence has to be led and cross-examined, contested divorces typically take considerably longer than mutual consent divorces and can become emotionally and financially demanding for both sides.
