Cruelty (Matrimonial)
Conduct by one spouse — physical or mental — that makes it unsafe or intolerable for the other spouse to continue living with them.
Cruelty as a ground for divorce isn't limited to physical violence; courts have recognised a wide range of conduct as mental cruelty, including persistent humiliation, false allegations, and deliberate neglect, when it is serious and sustained enough to make cohabitation genuinely intolerable.
Because "cruelty" isn't exhaustively defined, courts assess it on a case-by-case basis, considering the specific facts, the parties' background, and the cumulative effect of the conduct.
