Divorce Recrimination
A defence in a contested divorce where the respondent alleges that the petitioner is equally or more at fault, sometimes affecting the outcome of the case.
Where both spouses have engaged in conduct that could independently support a divorce claim, courts examine the overall circumstances, though the mere fact that both parties share some fault doesn't automatically prevent a divorce from being granted where the marriage has genuinely broken down.
This is more relevant in some fault-based divorce systems and is treated with practical flexibility by Indian courts in the interest of resolving genuinely broken marriages.
