Foreign Divorce Recognition
The legal question of whether a divorce decree obtained in a foreign country will be recognised and given effect to in India.
Indian courts examine whether the foreign court had proper jurisdiction, whether the decree was obtained on grounds recognised under the parties' applicable Indian personal law, and whether the process was fair — a foreign decree obtained through proceedings the other spouse wasn't properly given a chance to contest may not automatically be recognised.
This issue frequently arises for NRI couples where one spouse obtains a divorce abroad while the other remains in India.
