Irretrievable Breakdown of Marriage
A situation where a marriage has broken down beyond any realistic chance of reconciliation, even though it may not fit neatly into a specific statutory ground for divorce.
While not a formal ground under every personal law statute, the Supreme Court has, using its special constitutional powers, granted divorce on the basis of irretrievable breakdown in specific cases where continuing the marital tie serves no purpose and only prolongs the parties' suffering.
This remains an exceptional remedy generally invoked directly before the Supreme Court, rather than something available as a matter of course before ordinary family courts.
