Mutual Consent Divorce
A divorce granted when both spouses agree to end the marriage and jointly petition the court, rather than one contesting against the other.
In a mutual consent divorce, both spouses agree that the marriage has broken down and jointly file a petition, usually along with an agreed settlement on issues like maintenance, custody, and property. It is generally the fastest and least adversarial route to legally ending a marriage.
Most personal laws require a mandatory "cooling-off" period between the first and second motions, giving couples time to reconsider, though courts have discretion to waive this period in appropriate cases.
