Product Liability

The legal responsibility of a manufacturer, seller, or service provider for harm caused by a defective product, regardless of whether they were personally negligent.

Product liability claims let a consumer harmed by a defective product seek compensation from the manufacturer or seller, based on the product itself being defective — whether due to a manufacturing flaw, design defect, or inadequate warning — rather than needing to prove the manufacturer was careless in a broader sense.

This remedy exists alongside, and doesn't replace, the consumer's regular right to a refund or replacement for a defective product.
