Restitution of Conjugal Rights

A court remedy directing a spouse who has withdrawn from the other's company, without reasonable cause, to resume living together.

This remedy is available to a spouse whose partner has withdrawn from cohabitation without a valid reason, and asks the court to direct the other spouse to return and resume marital life together.

If the decree is not complied with for a specified period, non-compliance itself can become a ground for divorce for the aggrieved spouse — making this remedy relevant both on its own and as a step toward a later divorce petition.
