Second Motion (Divorce)
The second and final step in a mutual consent divorce, filed after the mandatory waiting period, confirming both parties still wish to proceed.
After filing the first motion in a mutual consent divorce, couples must wait out the statutory cooling-off period before moving the second motion, where both parties reaffirm their consent, after which the court can grant the final divorce decree.
Courts have discretion to waive this waiting period in genuine cases where reconciliation is clearly not possible and prolonging the process would only cause further hardship.
