Void Marriage
A marriage that is invalid from the very outset, as though it never legally took place, due to a fundamental defect such as a subsisting prior marriage.
Certain marriages are treated as void ab initio — meaning no valid marriage ever came into existence — typically where one party was already validly married to someone else at the time, or the parties are within prohibited degrees of relationship.
A party doesn't strictly need a divorce to be free of a void marriage, though it is common and advisable to still obtain a formal declaration of nullity from the court for legal clarity.
